GENERAL TERMS AND CONDITIONS (GTC) – WINTER SEASON 2020/2021

1. GENERAL PROVISIONS

1.1 These general business conditions for the winter ski season 2020/2021 issued by SPORTxLysa s. r. o., with its registered office at Budovateľská 34, Prešov, 080 01, IČO: 52705153, registered in the Commercial Register kept by OS Prešov, section Sro, insert no. 39166/P (hereinafter referred to as “Ski Lysá” or “operator”), regulate the provision of services – transport by chair lifts, ski lifts and use of ski slopes in the Ski Lysá resort and regulation of rights and obligations related thereto.

1.2 During the winter ski season 2020/2021, the customer has the opportunity to purchase a ski ticket (hereinafter referred to as “ski passes”) for the prices listed in the Price List issued by SPORTxLysa s. r. o., for the winter ski season 2020/2021. The contract of carriage is concluded at the moment of entry to the boarding station or boarding area of the chairlift (mountain transport facility), which is an area accessible only with a valid Ski Pass or Ticket.

1.3 The sale of Ski Passes or Tickets is at the box office in the ski resorts operated by SPORTxLysa s. r. o. implemented from the beginning of the winter season 2020/2021. The sale of Ski passes or Tickets is carried out by cash payment to the box office or by non-cash payment by means of a payment card. Ski passes can be purchased from the beginning of the winter season 2020/2021 through the online store (https://eshop.skilysa.sk/) for prices listed in the price list valid for the winter season 2020/2021, which is published at the box office in the Ski Lysa resort and on the website skilysa.sk, under the conditions set out in the User Agreement, Terms and Conditions relating to the online store listed at https://eshop. skilysa.sk/.
1.4 The ski pass is issued by SPORTxLysa s. r. o., exclusively in the form of a contactless chip card. The deposit for the chip card is 5 EUR. The ski pass holder can return the contactless chip card on any day until the end of the winter ski season 2020/2021 at the Ski Lysá ticket office between 8:00 and 16:30. The deposit for the contactless chip card in the amount of EUR 5 will be refunded in full only in the case of returning an undamaged card. The price of the Ski Pass includes the intervention of the Mountain Rescue Service in the event of an accident or a sudden deterioration of the customer’s health during the use of the services provided by SPORTxLysa s. r. o., if the accident or sudden deterioration of health occurs on the ski slope or route during the operating hours of the resort and the period of validity of the ski pass.

2. SKI PASSES

2.1 The time ski pass (3-hour) is non-transferable and is valid for 3 consecutive hours from the time of the passenger’s first passage through the turnstiles on the day which was purchased.

2.2 The ski pass for 1 day is non-transferable and is valid for one day for which it was purchased during the operating hours of the Ski Lysa resort.

2.3 The multi-day ski pass (2-, 3-, 4- and 6-day) is non-transferable and is valid from the date of purchase of the relevant multi-day ski pass or from the day indicated on the ski pass for the next two to six calendar days (depending on the type multi-day ski pass purchased by the customer).

2.4 Family ski passes are valid according to the type of ski pass for 2 adults and 1 or 2 children up to 15 years. Children must meet the condition of applying the discount for children (see point 3.2). To verify the age of children, it is necessary to prove their identity by insurance card or similar identification card.

2.5 The Seat ride ticket represents a return ride only on the “lower” chair lift (TATRAPOMA TS-2) starting near by Ski Lysa resort box offices.

3. DISCOUNTED SKI PASSES

3.1 Children under the age of 5.99 are entitled to free use of the services only on condition that they use the services exclusively accompanied by an adult over the age of 18 (maximum 2 children accompanied by 1 adult over the age of 18). In order to claim the purchase of a ski pass at the box office (offline), it is necessary to present the child’s insurance card or other document proving the child’s age.

3.2 Children aged 6 to 14.99 are entitled to a discounted “Children” ski pass. To claim the purchase of a ski pass at the box office (offline), the customer is obliged to present the child’s insurance card or other document proving the child’s age.

3.3 The purchase of a family ticket (2 + 1 or 2 + 2) is possible under the conditions of identical surnames resp. identical residence of the family, presentation of the parents’ ID card and children’s insurance cards. Children must meet the condition of a child discount. Ski Lysá resort do not provide additional discounts on these tickets.

3.4 Combining discounts is not possible. The best price for the customer applies. The ski resort reserves the right to change the tariffs of transport Tickets and Ski Passes.

4. SEASONAL SKI PASSES

4.1 Seasonal ski passes listed in the SPORTxLysa s. r. o. Price List valid for winter season 2020/2021 can be purchased during opening hours at the box office located directly in the Ski Lysá resort, or via the e-shop (https://eshop.skilysa.sk/). All seasonal ski passes purchased at points of sale in the resort and through the e-shop are non-transferable and personalized – that is, they are issued in the name and surname of the holder.

4.2 Seasonal ski passes expire with the official end of the winter season 2020/2021. If the customer did not use the Skipas season during the winter season 2020/2021 (he did not ski for a single day during the season, ie he did not go through the card reading device (turnstile) during its duration (hereinafter only the turnstile), then he is entitled to a 100% discount from the price of the seasonal ski pass paid for the following winter season 2021/2022 If the customer skied for 1 to 3 days during the winter season 2020/2021, he is entitled to a 50% discount from the price of the seasonal ski pass paid for the following winter season 2021/2022. After leaving 4 or more days, no discount will be provided. NOTICE: As soon as the customer goes through any turnstile during the day – even if only once, it counts as 1 day!

5. RESORT OPERATION AND OPERATING HOURS

5.1 The operation of the chair lift and ski lifts depends on the specific weather conditions in the Ski Lysá resort. By putting the lifts into operation, the operator of the Ski Lysá resort guarantees that the slopes are always groomed and suitable for safe use. At the same time, the operator is not responsible for changes in the quality of life and quality of snow during operating periods affecting weather conditions.

5.2 The operating hours of ski lifts and ski runs are determined by SPORTx-Lysa s. r. o., depending on weather and operating conditions in the Ski Lysá resort.

5.3 Unless otherwise specified by the operator, the operating time of the chair lift is from 8:30 to 16:30. The operating hours of the ski lifts and ski slopes in the Ski Lysá resort are from 9:00 to 16:00. during day skiing.

5.4 In the period from the beginning of the winter ski season to the end of the winter ski season 2020/2021 in the time from 16:00. do 9:00 THE SLOPES ARE CLOSED! There is a risk of injury from snow cables and track conditioning machines, especially winches with a developed rope!

5.5. The company SPORTxLysa s. r. about. is entitled to unilaterally change the operating hours of transport facilities and ski runs. Information on snow conditions and the operation of ski lifts and ski trails are available daily at the ski resorts of Ski Lysá, as well as on the website www.skilysa.sk.

5.6 The ski resort reserves the right to limit the transport capacity according to the current occupancy and weather conditions. The operator reserves the right to close transport facilities in case of failures, excessive wind speed, power failure and the like. The consumer is not entitled to a refund in the event of interruption of operation caused by extraordinary circumstances which are beyond the effective control of the operator and which could not have been avoided even if all possible effective measures had been taken (eg force majeure)!

6. LOSS, THEFT AND DAMAGE OF THE SKIPASS

6.1 In the event of loss, theft or damage to the ski pass, the ski pass holder is not entitled to a refund of the amount paid or the aliquot amount or to any other form of compensation for the negotiation days due to the loss or theft of the ski pass.

6.2 In case of loss, theft or damage of the Seasonal Ski Pass, the holder is entitled to issue a replacement ski pass. The handling fee is in the valid prices of the deposit for ski passes according to the valid price list. A replacement ski pass will be issued on the basis of the unambiguous identification of the holder (ID card, etc.).

7. COMPLAINTS AND REIMBURSEMENT OF TRANSPORT SERVICES

7.1 Provision of services to SPORTxLysa s. r. about. is governed by the relevant provisions of Act no. 40/1964 Coll. Of the Civil Code as amended in connection with the requirements of the provisions of Act no. 250/2007 Coll. on consumer protection and on the amendment of the Act of the Slovak National Council no. 372/1990 Coll. on offenses as amended and other generally binding legal regulations.

7.2 The customer has the right to provide transport services for in the agreed or normal scope, quality, quantity and date.

7.3 The customer is obliged to assert claims for service defects (complaints) without undue delay after finding out the reasons for the complaint (defect or defects of transport services – failure to make adjustments), in principle on the day of event or defect happened, otherwise the rights to complaints expire.

7.4 The customer is obliged to present ski passes and identity cards when making a complaint. After reviewing the complaint, the operator decides on the method of handling the complaint immediately, in complex cases within 3 working days. The deadline for handling complaints does not exceed 30 days from the date of its application. Preliminary purposes of handling complaints, the customer is obliged to provide contact information, through which the customer will be notified of the method of handling complaints in the event that it is not possible to handle complaints immediately after its application. The customer is obliged to provide the operator with the necessary cooperation required by the operator when handling a complaint.

7.5. Compensation for ski passes

7.5.1 The operator may provide the ski pass holder with a fare reimbursement for a day on which no transport has taken place in the event of a failure of the transport facility for more than 3 hours and at the same time the transport capacity of the centre’s transport facilities has been reduced. from lifts H300, H130 and H60 in operation:
a) by 12:00 noon the ski pass holder is entitled to a refund of the fare, in the form of a 1-day ski pass valid at the Ski Lysá resort.
b) in the time from 12:00 The ski pass holder is entitled to a refund of the fare, in the form of a 3-hour ski pass valid at the Ski Lysá resort.

7.5.2 The replacement ski pass provides only one-day and multi-day ski passes and family ski passes.

7.5.3 The right to obtain a replacement ski pass expires if the ski pass holder performs after the start of the lift into operation min. 1 passage through the turnstile.

7.6 The Operator reserves the right to an individual assessment of each case of a complaint about services and to assess the legitimacy of the complaint and the customer’s requirements and the refund provision and its method or amount.

8. FINAL PROVISIONS

8.1 By purchasing a ski pass and using the services in the Ski Lysá resort, the customer undertakes to continue after each authorized employee of the operator, transport conditions, these general business and conditions and the White Code, which is published on the company’s website www.skilysa.sk and available in the Ski resort. The company SPORTxLysa s. r. o. is entitled to devalue (block) the ski passes and thus prevent customers from using the services in the Ski Lysá resort in the event that it is found that the ski passes are used by a person who is not authorized to use the ski resort services. Discounted ski passes are valid only with a card proving the right to issue a discounted ski pass. In case of impairment of the ski pass due to violation of the general terms and conditions (in case of misuse of the ski pass for the reason that is the subject of unauthorized use of services provided in Ski Lysá), the customer is not entitled to any other financial or non-financial compensation , nor the right to a refund of customers’ price paid or an aliquot part thereof.

8.2 The ski pass does not entitle its holder to conduct business or other gainful activities (including the activities of ski schools) on ski slopes and access ski resort without the consent of SPORTxLysa s. r. o. as an operator and the relevant permit in accordance with generally binding legal regulations. Without the consent of the operator, it is forbidden to use the ski slopes and other Ski Lysá resort spaces for advertising purposes (eg location of sales stands, advertise placing and others).

8.3 The holder of the ski pass, by purchasing and paying the ski pass, acknowledges that the personal data provided when purchasing the ski pass are processed in accordance with Act no. 18 / 2018Z. from. on Personal Data Protection and on Amendments to Certain Acts (hereinafter referred to as the “Personal Data Protection Act”).

8.4 Due to the nature and construction of the transport equipment, the operator is not responsible for any contamination of clothing and equipment in such adverse weather (rain). The visitor can exclude possible damage that seriously caused the ski tracks on the lift at a distance of 0.5 m from the axis of the lane.

These general terms and conditions enter into force and effect on 1 December 2020 and are valid and effective throughout the winter ski season 2020/2021. These general business conditions are provided for the provision of services – use of ski lifts and ski slopes in the Ski Lysá resort. Ski passes issued by SPORTxLysa s. r. o., which are valid in other ski roofs, are governed by the general business conditions valid in the given resort.
